PURPOSE
These Purchase Conditions establish the rights and obligations of all users of the balagium.com online store in relation to the products we offer through our website educachess.org.

By using the balagium.com website or placing an order through it, you acknowledge that you are bound by these Conditions and by our Privacy Policy; therefore, if you do not agree with all the Conditions and the Privacy Policy, you must not place any order.

These conditions may be amended; therefore, you must read them before placing each order.

How to make an ONLINE PURCHASE

1.- Access www.educachess.org
– Select the type of product you wish according to the different categories.
– Use the search engine.
– Once you have found the product you want, click “add to cart”.

2.- Cart
– You will be able to view the products added to the cart.
– If you wish to complete the purchase, click the “buy” button.

ORDERS
– Placing an order on balagium.com implies full and unconditional acceptance of the prices, product descriptions, and the general terms of sale, which shall be the only terms applicable to the contract thus concluded.
– The buyer undertakes to use the balagium.com website solely to make legally valid enquiries or orders. The buyer also undertakes to provide truthful and accurate contact details, thereby consenting to the use of such information to contact them if necessary.
– You may place your order without registering, by providing the required shipping details.
– Orders will be delivered by AIDE through a transport agency designated by balagium.com. Orders will be delivered to the address designated by the customer or to AIDE’s premises, if the customer so decides.
– balagium.com shall not assume any responsibility when delivery cannot be made due to inaccurate or incomplete information provided, or due to the absence of the recipient.
– balagium.com undertakes to deliver the products in perfect condition to the delivery address indicated on the order form. You may request delivery of the items to a different address and to a different individual from the person placing the order.
– With regard to deliveries to hospitals, public bodies, and other buildings with restricted public access, balagium.com does not guarantee delivery directly to the recipient. The order shall be deemed fulfilled and balagium.com released from liability once the order has been made available to the recipient at reception or at the relevant access control point.
– Delivery timeframes are calculated based on various factors, including the destination address and the speed at which we can process and prepare the products in the order for shipment.
– Orders will be delivered within two to three days from dispatch throughout mainland Spain, depending on the items ordered and the delivery address.
– For deliveries at a scheduled time, an additional day will be required.

PAYMENT
– AIDE offers the possibility of payment by bank transfer, cash on delivery, or card payment. Credit card charges are processed at the time the order is placed, through the payment gateway of the corresponding financial institution, once the provided details have been verified.
– In this regard, confidential data are transmitted in encrypted form (SSL) to the corresponding financial institution. The SSL encryption system used guarantees complete security for data transmission over the network. Your data enjoy full confidentiality and protection.
– Security in electronic purchases is guaranteed by the corresponding financial institution, which has the necessary security measures to detect possible errors in the data provided when making card payments.
– Credit card details are not stored in any of our databases. They are used exclusively through the virtual POS (Point of Sale Terminal) of the corresponding financial institution, via its secure payment gateway.
– Credit cards are subject to verification and authorization by the issuing institution; if the institution does not authorize the payment, we shall not be responsible for any delay or failure in delivery, and no contract may be concluded with you.
– AIDE reserves the right to modify payment methods, create new ones, or remove existing ones, without the user/customer being entitled to make any claim in this regard. However, if a change in the payment method affects an order already placed, AIDE will contact the customer via info@educachess.org to inform them of the change and offer the option to cancel the order if they so wish.

PRICE AND VALIDITY PERIOD OF THE OFFER
– The prices indicated for each product are total prices (VAT included). Shipping costs, which are specified for each destination and selected transport option, must be added. Prices are shown in euros.
– The prices and conditions displayed are valid at any given time and apply only during the active session. In the order confirmation information, prior to the buyer’s acceptance of the transaction, the prices of each selected item, the applicable delivery costs, and any promotions or discounts, where applicable, are clearly specified.
– balagium.com reserves the right to modify sales prices at any time; however, items will be invoiced based on the rates in force at the time the order is registered, subject to availability on that date.

RETURN OR REPLACEMENT POLICY
– The customer has the right to withdraw from the order within 14 calendar days from receipt, after prior notification to balagium.com (by email to info@educachess.org), with a refund of the price paid for the product. Returns will be processed without penalties, and AIDE (International Association for the Promotion of Chess) will refund the full purchase amount, including shipping costs where applicable.
AIDE offers the option to return any purchased product via courier or by delivering it to AIDE’s physical locations. To process a return, the product must be complete and in perfect condition. Regarding the returned product’s packaging, it is not necessary for it to be in its original condition; however, if this is not the case, the product may suffer depreciation.

– If, at the time of delivery, visible and clear defects caused by transport damage are observed without the need to manipulate the packaging, or if a defect in the received goods is detected, including during the warranty period, the customer may notify AIDE (telephone +34 686 72 48 44 or email info@educachess.org) within 24 hours, attaching a photograph.
balagium.com will be responsible for replacing the product with a new one or refunding the price paid. Repair and/or replacement of the defective product shall be free of charge for the consumer and user, including any necessary costs incurred to remedy the lack of conformity, such as shipping costs.

LIABILITY
– AIDE shall not be held liable for any damages, of whatever nature, whether material, immaterial, or bodily, that may arise from improper operation or use of the products sold.
– The same shall apply to any modifications made to the products by suppliers. AIDE shall not be liable to the customer or third parties for indirect damages, loss of profits, or loss of business, regardless of the means by which such damages occur, even if such damages were foreseeable or their possibility had been brought to AIDE’s attention.
– AIDE shall not be liable for failure to perform the contract in cases of force majeure, interruption of activity, or total or partial strikes, especially affecting postal services and means of transport or communications, as well as floods or fires.
– The provisions of this clause shall not affect the rights recognized by law for consumers, nor the right to withdraw from the contract.
– In the event of a dispute, the customer may first contact AIDE in order to seek an amicable resolution.

INTELLECTUAL PROPERTY RIGHTS AND OTHERS
The buyer acknowledges and accepts that the elements and intellectual, industrial, or other property rights (including, without limitation, copyrights, patents, trademarks, designs, photographs, images, and source codes) relating to the educachess.org web platforms to which access may be granted are the exclusive property of AIDE.
The user may not, directly or indirectly, copy, modify, alter, publish, communicate, distribute, sell, or transmit the materials of this platform, in whole or in part, without the written authorization of balagium.com.

APPLICABLE LAW
These General Conditions shall be governed by and interpreted in accordance with the applicable legislation. Any disputes arising from commercial relations between the user and AIDE shall be subject to the provisions of the applicable law.
